The trust of all those with whom we do business is Farber’s most valuable asset. Farber safeguards that trust by collecting, using and keeping non-public personal information about those with whom it does business, be they clients, debtors, creditors, suppliers or strategic partners, in a secure environment and in accordance with this Privacy Statement.

Who is the “Data Controller”
Farber is the “data controller” of personal data collected by all of Farber Group, A. Farber & Partners Inc., Circle & Square, and Tax Solutions Canada. As data controller, Farber is responsible for the safekeeping of all personal information on a computer or in structured manual files. We understand our legal obligation to protect your information, and we take that obligation very seriously.

Collecting and using information

We will tell you how we intend to use personal information we collect about you and will use it only for those purposes. We will obtain your consent to the collection and use of your personal information, either expressly, or, where appropriate, where it is implied. We will only collect the information we need for those purposes of which we have advised you. If we wish to use your information for any other purpose, we will obtain your consent, expressed or implied, before we use it.

Online services
Our website is for general information use and there is no registration required to visit any of our sites. We do not collect any personal information from site visitors other than cookies, the use of which is outlined in our Cookie Notice. There are circumstances where you may choose to register or subscribe. In these cases, Farber may contact you at your request under the premise of your subscription. Executive search portal
The portal located at: enables you to register and apply for an advertised vacancy that Farber is filling on behalf of another company. If you choose to apply through the portal, Farber will have access to your resume and cover letter. The company with the vacant position you are applying for may also have this information and you need to read that party’s privacy policy to understand how your information is used and retained for future job positions with that particular organization.

Email alerts
Farber allows you to subscribe to our news and event notifications. If you subscribe, we collect your name, email address, company name, and job title so that we can send information that is relevant to you and your current role. You may also select topics that you personally find interesting.

Event registration
Farber events are managed via our website. On occasion, we use third-party vendors to process any payments. If registering for an event, please check the details provided by the third party to understand how your information will be used and retained by them.

Careers at Farber
If you apply for a career at Farber, we will keep your cover letter, resume, and any documents you supply to us in the event that they are relevant for another opportunity.

You may refuse or withdraw consent for us to collect, use or disclose your information at any time and we will record and respect your choice. Certain consequences may flow from such refusal or withdrawal and we will advise you of those, if applicable, at that time. Such a decision must be communicated by you, in writing, to our Chief Privacy Officer, at the address indicated below.

Why we ask for your information
We ask for your information to establish and serve you as our client, or on behalf of our client(s) or others whose interests we may represent. The information we obtain depends on the nature of the engagement in question, and of our relationship with you. We may require personal information about you in order to fulfill certain statutory obligations, to assist you in fulfilling your own statutory obligations, or to determine your right to participate in an engagement which we have undertaken. We may obtain information about you from many sources, including the following:

Information we receive from you, or which is provided to us on your behalf, on Statements of Affairs, Statements of Income and Expenses, Proofs of Claim, and other forms, such as your name, address, date of birth, telephone number, employer, marital status, number and type of dependents, assets, liabilities, expenses, and income.

Information from third parties about your transactions with them or others, such as your name, address, telephone number, age, credit card usage, insurance coverage, transaction history, account number(s), claims history, level of indebtedness, and asset ownership and usage.

Information from consumer reporting agencies, public records and data collection agencies, such as your obligations with others and your creditworthiness.

Information from credit counselors or other advisors including name, address, telephone number, age, marital status, credit usage, employment history, addictions, social history and other information relating to your solvency, or the solvency of others.

When we release your information
Farber may release your information to third parties in the following instances:

With your consent – You may consent to Farber sharing your information with a third party, or to other member companies of Farber.

For servicing purposes to our suppliers and agents – We give limited information, only as needed, to our suppliers and agents who provide goods and services to you, or to us in order to allow us to carry out our engagement.

When required or permitted by law – We must give personal information in response to a legally valid enquiry or order. We may disclose personal information to help us collect a debt owed to us by you. We are also obligated to complete certain statutorily mandated forms in the course of carrying out engagements where we are the Trustee in Bankruptcy or the Trustee or Administrator under a proposal, which will necessarily involve the disclosure of certain personal information.

Transfers of a business – We may sell parts of our businesses. Personal information relating to your relationship with us may be one of the transferred business assets.

How we protect your information
Farber restricts access to your personal information to employees of our member companies and our agents whom we determine have a legitimate business purpose to access such information in connection with carrying out of our engagements or in the provision of services to you. We employ security techniques designed to protect our customer data. We provide training and communications programs designed to educate employees about the meaning and requirements of our strict standards for data security and confidentiality.

All our suppliers and agents, as part of their agreements with us, are bound to maintain your confidentiality and may not use your personal information for any unauthorized purpose.

When your personal information is no longer needed for the purposes explained to you, we have procedures to destroy, delete, erase or convert it to an anonymous form.

On May 25, 2018, the General Data Protection Regulation came into effect. The aim of the GDPR was to further enhance the data protection and privacy rights of individuals, to give them more control over their personal data. Although it is a European regulation, the scope of the GDPR applies to any company that offers good or services to a EU resident. Farber has become GDPR-compliant out of respect for your rights.

Your right to access your information

The GDPR outlines rights deriving from the principle that the individual whose data is being processed continues to own that data throughout our stewardship of it. Below is a list of the newly accorded rights that Farber respects under the GDPR:

  • the right of rectification
  • the right to erasure
  • the right to restrict processing
  • the right to data portability
  • the right to object

If you require information, simply forward a written request to the address appearing at the end of this Privacy Statement. There will be no charge for the information you request, unless stated, and we will respond to your request as promptly as possible.

We will not be able to provide information from our records if those records contain references to other persons, are subject to legal privilege, contain confidential information proprietary to Farber or cannot be disclosed for other legal reasons.

If you have questions regarding decisions made about you, we will tell you the reasons for those decisions.

Privacy Breach Reporting
As of November 1, 2018, new federal provisions will come in to full effect under the Personal Information Protection and Electronic Documents Act (PIPEDA), detailing the mandatory disclosure process in the event of a privacy breach. Farber will be fully compliant with these new provisions.

Upon determining that a privacy breach has occurred, Farber will immediately notify affected individuals, as well as the Privacy Commissioner of Canada–in accordance with the new provisions.

Keeping your information accurate
We will make every reasonable effort to keep your personal information accurate and up to date.

You can help by keeping us informed of any changes in the information, such as a change in email or mailing addresses or telephone numbers. If you find any errors in our information about you, tell us and we will correct the information. We will also convey the corrected information to other parties as needed. For information that remains in dispute, we will note the dispute in your file.

Children’s Privacy
We understand the importance of protecting the privacy of children. This website is not designed or intended for use by children, nor do we knowingly collect or store information about children.

Canada’s Anti-Spam Legislation (CASL) prohibits companies from sending commercial electronic messages (CEMs) to an electronic address, without a person’s consent. Farber remains CASL-compliant and has made every effort to provide our contacts with clear options to subscribe and unsubscribe to our CEMs.

Changes to the Statement
Farber may change this Statement at any time. We respect your rights and may notify you to keep you informed of our actions.

Respecting your preference
We will explain your options of refusing or withdrawing consent to the collection, use or disclosure of your information and will record and respect your choices. If you would like to unsubscribe from Farber mailing lists, please email us at and simply write ‘Unsubscribe’ in the subject line with your name. It is important to note that choosing this option will not stop Farber from sending you business emails relating to a current Farber engagement or other communications that we are legally required to send to you.
